Terms & conditions

When booking Val Tannuzzi Photography, LLC, the client agrees to the following terms:

​

Session Fee/Payments

A non-refundable retainer of $50 is required for all portrait sessions ($100 retainer for jobs over $500). The retainer shall be applied towards the total cost of the service to be rendered. The remaining Session Fee balance is due at the time of your photoshoot. This fee covers the time of photographer, retouching and creative editing of images. Your deposit allows for ONE appointment rescheduling.

All payments are due in full at the time of the photo shoot. Galleries will not be delivered until payment in full is received. 

​

Methods of payment accepted for deposit: PayPal, Venmo, Zelle & Cash App. Also accepted on shooting day: Cash & check.

​

Late Arrivals.

Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session. This may also result in a reduction of the number of proofs and edited images (please keep in mind that I might have someone scheduled before and/or after you). If you arrive more than 30 minutes late, I consider it a no-show, your session is cancelled and your deposit is forfeited.

Rescheduling & Cancellations. 

If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 2 days prior to their shoot to be able to use the same retainer. (Rescheduling does not apply for out of town sessions, but all efforts will be made to meet at the photographer's location at a later date). 

NO SHOWS will lose their deposit, and will not be booked again.

Weather

Although I do not mind shooting while overcast and/or light raining, storm clouds may affect the quality of the pictures -if the client chooses natural light photography. I only cancel due to inclement weather when I know it is going to affect your safety and/or the quality of images.

​

Re-shoots. 

I do not offer reshoots, revisions, or refunds other than for technical failures or malfunctions that prevent me from delivering the agreed upon number of technically proficient images. Re-shoots will not be given for poor choices of clothing, make-up, hair, or by not following the recommendations of the photographer.

Copyright 

Val Tannuzzi Photography, LLC retains all copyrights to all images created during client’s session, but shall grant permission to the client to reproduce and publicly display their images. Any print publications or video editors/producers wanting to use your images MUST request permission to use images or arrange licensing fees by contacting Val Tannuzzi Photography, LLC at least 30 days before the intended date of publication.

This release does not allow selling or significantly altering (including but not limited to social media filters and AI technology) of your images without the photographer’s permission. Editing not performed by Val Tannuzzi Photography will be considered a violation to copyright.

Commercial Use of Acting Headshots

Acting headshots are intended to be used for casting submissions and general portfolio purposes within the acting industry. When an acting headshot is used for commercial purpose with the intention of making a profit (merchandise use), or resale and distribution of their images (for example, signed autographs) a license fee and fair compensation will need to be worked out with the photographer.

Acting headshots are not intended to be used for your corporate or business purposes (business cards, works badges, business advertising, real estate, etc.) 

​

Commercial Use of Business Photography

Business photography is not intended to be used for directly making a profit or resale and distribution of images (for example, merchandise creation). A license fee and fair compensation will need to be worked out with the photographer for these purposes.

Proofs & Archive

You will have the opportunity to review images directly from the camera as we shoot. I will show you your images throughout the shoot, to ensure we are getting exactly what we need from the session. 

 

Gallery of all client’s images will be available for viewing within 48 hours of session date (72 hours for out of town events). This gallery includes all the usable photographs taken during the session in an online gallery with a "PROOF" vertical watermark. All images will be available for one (1) month following client viewing date. After one (1) month, all images will be purged from photographer’s Google drive. Please make sure you download all files to your drive or device. RAW images are purged from the photographer's files after 90 days.

All editing choices MUST be made within 90 days of the date of your photoshoot. After 90 days, the photographer will no longer keep your RAW files.

Photo Release.

Client gives permission to Val Tannuzzi Photography, LLC to use the images (or variations of the images) from this session for publication in websites, blogs, portfolios, displays, or other promotional methods for Val Tannuzzi Photography, LLC without compensation for such. Val Tannuzzi Photography, LLC will not sell these images to any third party without consent from the client.

 

Failure to Perform.

If the Photographer cannot perform this Contract due to fire or other casualty, strike, act of Mother Nature, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.

In the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond photographer's control, photographer's liability is limited to scheduling a new session in order to complete services paid for. The photographer is not responsible for refunding any fees or any other expenses or fees paid by the client to any third party such as a makeup artist.

Indemnification.

The Photographer and Val Tannuzzi Photography, LLC shall be held harmless for any and all injury to the client during the course of the photography session and the immediately surrounding events. Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
